BANKRUPTCY, INSOLVENCY & RESTRUCTURING
The firm’s bankruptcy, insolvency and restructuring practice represents clients in a broad range of commercial litigation and transactional matters, with emphasis in domestic and international insolvency, creditors’ rights, bankruptcy, restructuring, and reorganization.
ADDRESSING YOUR NEEDS
Recognizing that our environment and challenging economy require increasingly creative strategies to avert serious financial difficulties, or to resolve them in the event they arise, members of the practice group act as key advisors in the structuring and restructuring of businesses as well as the structuring of business and real estate acquisition and divestiture transactions, and pursuit of remedies, when necessary, in and out of judicial proceedings.
Our experienced attorneys make certain that our clients – debtors, creditors, and investors alike – are fully aware of how the bankruptcy process works, the benefits – and detriments – of Chapter 11, who is likely to take which steps and when the client can effectively respond. The field of bankruptcy and insolvency is often similar to a chess match requiring sharp, anticipatory strategic skills and the ability to understand who or what is indispensable to achieving the desired result and how to get the key players to agree upon a mutually acceptable outcome. Our mission is to assist our clients in reaching the most advantageous, achievable position.

* Represent substantial and high-profile private and publicly held business debtors both within and outside of Chapter 11 proceedings.
* Represent trustees in both Chapter 7 liquidation and Chapter 11 reorganization cases.
* Participate in real estate insolvencies and restructurings on behalf of lenders, developers and investors.
* Advise parties that are selling, purchasing or investing in distressed and insolvent businesses, both in judicial and non-judicial environments.
